ROS Agenda Date:May 6,2003 <br /> Agenda Item No.6 <br /> Accept the quarterly report from the Department of Environmental Health(Department)on prevailing conditions at 4140 <br /> Canada Road,a commercial poultry facility. <br /> FISCAL IMPLICATIONS <br /> There is no impact on the General Fund. Costs are fully covered by the Department of Environmental Heath(DEH)BU <br /> 261,IC 1196,Fund 0030, and the Vector Control District(VCD)BU 411,IC 4224,Fund 28. <br /> Inspections of the poultry facility by the Department are projected to exceed approximately three hundred fifty—one <br /> (35 1)hours per year. The combined hourly salary rate times the inspection hours(35 1)equals$28,388 that will be <br /> expended during the 2003-2004 calendar year to provide inspection and consultation services. <br /> This cost projection is a conservative figure as it does not account for other real costs such as Department overhead <br /> allocation, equipment operation and maintenance, and County Counsel costs. The Department does not recover any <br /> revenue for its inspection services of the poultry facility;with the exception of the benefit assessment charge the Vector <br /> Control District collects on this parcel which is$15.24 per year. <br /> CONTRACT HISTORY <br /> None <br /> REASONS FOR RECOMMENDATION <br /> Acceptance of quarterly reports will ensure that the Board is kept informed and updated on the status of Olivera Foods <br /> Poultry Ranch,4140 Canada Road,Gilroy,CA,concerning the prevailing conditions as noted on weekly inspection <br /> reports by the Department. <br /> BACKGROUND <br /> At the direction of Chairperson, Supervisor Blanca Alvarado,the Department has been asked to provide on an on--going <br /> basis,a report relating to the inspection assessments of Olivera Egg Ranch,4140 Canada Road,Gilroy CA,a minimum <br /> of once a quarter.This request was the result of the Public Hearing(Board Item 47)heard on February 25,2003 to hear <br /> the appeal by the ranch operator to the Board's preliminary finding of a public nuisance. The Board issued a finding of <br /> no public nuisance at this time,but had serious reservations about past operational deficiencies.As a result,the Board <br /> instructed the Department to work with the owner and operator to ensure that the ranch would operate consistent with <br /> accepted standards and practices for a commercial poultry operation. <br /> Seven(7)inspections of the commercial poultry facility(Attachment Al)have been conducted since the February 25, <br /> 2003. The weekly adult fly spot card countaverages,a measure to determine fly abundance and a useful tool to assess <br /> manure management and domestic fly control,have been below threshold action levels that would trigger a preliminary <br /> finding of a public nuisance. Weekly fly spot card average during this time period have been between ten(10) and <br /> thirty—one(31).
