Open Hearing and consider written and oral testimony from the property owner,operator and other persons as to <br /> whether a public nuisance exists as defined in Health and Safety Code section 2200(e)and Health and Safety Code <br /> section 2062 which takes effect on January 1,2003. <br /> b. Close Public Hearing. <br /> c. Grant Appeal, and find no public nuisance exists, or <br /> d. Deny Appeal,finding based on substantial evidence in the record that a public nuisance exists on the property;and <br /> 1)Order abatement by January 27,2003 and order the taking of necessary actions to prevent the recurrence of the public <br /> nuisance; and <br /> 2)Order that any recurrence of the public nuisance will be considered a continuation of the original nuisance;and <br /> 3)Authorize Vector Control District/Department of Environmental Health Inspectors to continue assessment of property <br /> for abatement of the nuisance and to issue penalties for noncompliance in the amount indicated on Attachment 12. <br /> 4)For any penalty remaining unpaid after assessed after sixty days,order the penalties charged and collected against the <br /> property. <br /> 5)Authorize any notice of the abatement lien to be recorded. <br /> FISCAL IMPLICATIONS <br /> There is no fiscal impact on the County General Fund. The impact on the Department of Environmental Health,Vector <br /> Control District Budget,Unit 411,Fund 0028 is unknown at this time.Any civil penalties received would be deposited <br /> into Budget 411, Fund 0028 pursuant to State law. <br /> CONTRACT HISTORY <br /> None <br /> REASONS FOR RECOMMENDATION <br /> Originally this transmittal was heard by the Board of Supervisor on December 10,2002 (Item No. 52).The Board <br /> continued the hearing to January 14,2003 for further noticing to residence surrounding the subject property.Notice of <br /> Public Hearing was sent to appellant and surrounding residents on December 23 and December 27,2002(see attached). <br /> Due to the continuance of the hearing it was necessary to amend the Notice to Abate and Recommended Action d(1), <br /> changing the the date by which abatement must be completed from December 19,2002 to January 27,2003 (see <br /> Board of Supervisors:Donald F.Gage,Blanca Alvarado,Pete McHugh,Jim Beall,Liz Kniss <br /> County Executive:Richard Wittenberg <br /> 2 <br />
