Hedding Street, San Jose, California <br /> Public Hearing <br /> Tuesday January 14th, the Board of Supervisors will resume the public hearing regarding the <br /> finding of a public nuisance—excessive adult and immature flies and delegation of authority to <br /> the Manager of the County of Santa Clara Vector Control District to levy civil penalties pursuant <br /> to California Health and Safety Code for non-compliance. <br /> The Board begins public hearing items on the agenda at 2:00 PM. The exact time when this <br /> item will be heard by the Board will depend upon what other items are on the agenda before it, <br /> and how long they take. <br /> Agenda and Staff Report is posted on the County Website <br /> The Board agenda and the staff report for this item are posted on the County's website as of <br /> December 10, 2002. <br /> The County's website address is www.sccgov.orq. Select December 10, 2002 and <br /> scroll down to agenda item Number 52 for all attachments. <br /> Recommended Actions <br /> Hearing to consider appeal of preliminary finding of existence of public nuisance related to <br /> Olivera Foods Egg Ranch located at 4140 Canada Road, Gilroy, CA. <br /> Possible Action: <br /> a. Open Hearing and consider written and oral testimony from the property owner, operator and <br /> other persons as to whether a public nuisance exists as defined in Health and Safety Code <br /> section 2200(e) and Health and Safety Code section 2062 which takes effect on January 1, <br /> 2003. <br /> b. Close Public Hearing. <br /> c. Grant Appeal, and find no public nuisance exists, or <br /> d.
