Dr . James T . P -n
Page 3
Week of October 12 . We fail to perceive how it is in
anyone ' s interest to delay the remedial investigation because
the department demands additional QA/QC second column
requirements in comments 13 and 23 that are not required
in law or regulation, are not part of accepted practice
or procedure in remedial investigations, and are not
cost effective.
If the state continues to insist upon this procedure, we
respectfully request the senior level review procedure
for good-faith disagreements over specific technical
diagnostic measures as outlined in Paragraph IX, page 8
of our Director' s Order Pursuant to Stipulation. This
provides an opportunity for "The Department , Regional Board,
and the Company to resolve the disagreement reasonably . "
Please respond as promptly as possible as our time schedules
are in jeopardy.
Except for this one problem, it is our observation that
work on the project is rapidly progressing. We are in
compliance with the Settlement Agreement , and the system
seems to be working well .
Very truly yours , .
Charles R. McCormick , III
President
McCormick & Baxter Creosoting Co.
CRMc/lc
cc: Mr. William Crooks
Central Valley Regional Water Quality Control Board,
Sacramento
Mr. Wayne Pearce
CH2M-Hill , Emeryville
Mr. Larry Shiba
McCormick & Baxter, Stockton
Mr. Ron Valinoti
San Joaquin Local Health Department , Stockton
Mr. Bill Stokes
Office of Assemblyman Pat Johnston, Sacramento
Mr. Richard Hammond
Heller, Ehrman, White & McAuliffe
San Francisco
Mr. Randy Peterson Mr. Gerry Reents
CH2M-Hill , Emeryville RWQCB
