We fail to perceive how it is in <br /> anyone ' s interest to delay the remedial investigation because <br /> the department demands additional QA/QC second column <br /> requirements in comments 13 and 23 that are not required <br /> in law or regulation, are not part of accepted practice <br /> or procedure in remedial investigations, and are not <br /> cost effective. <br /> If the state continues to insist upon this procedure, we <br /> respectfully request the senior level review procedure <br /> for good-faith disagreements over specific technical <br /> diagnostic measures as outlined in Paragraph IX, page 8 <br /> of our Director' s Order Pursuant to Stipulation. This <br /> provides an opportunity for "The Department , Regional Board, <br /> and the Company to resolve the disagreement reasonably . " <br /> Please respond as promptly as possible as our time schedules <br /> are in jeopardy. <br /> Except for this one problem, it is our observation that <br /> work on the project is rapidly progressing.
