( "McCormick & Baxter" ) on <br /> Monday, March 30, 1987 . <br /> By this letter I am informing the Department of Health <br /> Services and the Central Valley Regional Water Quality Control <br /> Board ( "Board" ) that McCormick and Baxter intends to comply with <br /> the requirement that we submit an approvable workplan within 30 <br /> working days of March 30, 1987 . <br /> We respectfully take issue with all assertions in the <br /> memoranda that characterize negatively McCormick & Baxter ' s <br /> intentions or performance under the Stipulation and Settlement <br /> Agreement, including but not limited to assertions that we are <br /> not committed to complying with the Stipulation and Settlement <br /> Agreement, that we are reluctant to develop complete assessments, <br /> and that the professional quality of our consultants ' work is <br /> inadequate. We acknowledge that some differences exist among the <br /> technical staffs as to data and analyses required for site <br /> characterization, interpretation of the data, and sequencing of <br /> the work. We note, however, that from the beginning McCormick & <br /> Baxter retained a technical firm that is an established leader <br /> both nationally and in California in the field of site <br /> characterization and remediation; and we state unequivocally that <br /> through that firm we have at all times timely prepared and <br /> submitted in good faith the documents required by the Stipulation <br /> and Settlement Agreement and, from time to time, required in <br /> writing by the Department and the Board. <br />
