In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action ) . <br /> On November 21 , 2018 , Stacy Rivera of the San Joaquin County Environmental Health Department (EHD) performed a routine <br /> underground storage tank inspection at the above referenced site . The site was found to be out of compliance . The violations include <br /> but are not limited to the following : <br /> -Failed to obtain a 2018 permit to operate . (HSC 25284) <br /> -Failed to construct, operate , and maintain primary containment as product-tight (1 /2 gallon of fuel was observed in the diesel STP <br /> sump, fuel leaks were observed under dispensers 516 , 9110, and 11112) ; (HSC 25290. 11 25290.22 25291 ) <br /> -On November 16 , 2017 , Elianna Florida of the San Joaquin County Environmental Health Department (EHD) performed a routine <br /> underground storage tank inspection at the above referenced site. An inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted 30 days after receiving the inspection report. <br /> This information has not been received resulting in a non-compliant status for this facility. The outstanding violation was observed and <br /> re-cited during the November 21 , 2018 inspection .
