I reserves all defenses in law and equity. <br /> 2 12. If all the conditions listed in paragraph 10 above are met,then five(5)years from the <br /> 3 filing date of this document,the stayed penalty shall be suspended permanently. <br /> 4 13. Defendant shall additionally pay to Plaintiff the sum of THIRTEEN THOUSAND ONE <br /> 5 HUNDRED TWENTY-FIVE DOLLARS ($13,125.00) as partial recovery of the cost of <br /> 6 investigation and suit incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH <br /> 7 DEPARTMENT. Said payment shall be due and payable to the aforementioned agency,and shall be <br /> 8 delivered to the San Joaquin County Office of the District Attorney,Environmental Crimes Unit,at <br /> 9 time of signing. <br /> 10 14. Defendant shall additionally pay to Plaintiff the sum of NINE THOUSAND DOLLARS <br /> 11 ($9,000.00) as partial recovery of the cost of investigation and suit incurred by the SAN JOAQUIN <br /> 12 COUNTY OFFICE OF THE DISTRICT ATTORNEY, Said payment shall be due and payable to <br /> 13 the aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br /> 14 Attorney,Environmental Crimes Unit,at time of signing. <br /> 15 15. In determining the appropriate amount of costs of investigation and suit incurred by the <br /> 16 San Joaquin County Environmental Health Department and the San Joaquin County Office of the <br /> 17 District Attorney in this matter the Plaintiff has taken into account the fact that Defendant previously <br /> 18 paid the following costs of investigation and suit incurred in San Joaquin County Superior Court <br /> 19 Case No. 39-2015-00327181-CU-TT-STK: <br /> 20 $1,000.00—Paid to the San Joaquin County Environment Health Department on <br /> 21 August 8,2016; and <br /> 22 $3,000.00—Paid to the San Joaquin County Office of the District Attorney on August <br /> 23 8,2016. <br /> 24 16. Upon Defendant's full payment(confirmed by the County Auditor-Controller) of this <br /> 25 Judgment,the People will execute, file, and deliver endorsed filed copies of Acknowledgment of Full <br /> 26 Satisfaction of Judgment EJ-100 in the forms attached hereto for the following San Joaquin County <br /> 27 Superior Court Cases: <br /> 28 Exhibit A 39-2015-00327181-CU-TT-STK <br /> - 10- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT-TO STIPULATION <br />
