SAN J OAQU I N Environmental Health Department <br /> CC LJ N T Y------- <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> TEC Equipment 2050 E Louise Ave, Lathrop September 21, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 204 CFR 112.3(g) Failure to prepare SPCC Plan when facility no longer meets Qualified Facility criteria. <br /> OBSERVATION: Facility failed to prepare appropriate Spill Prevention Control and Countermeasure(SPCC)plan <br /> when it is no longer meeting the conditions of Tier I Qualified Facility: Facility currently has a Tier I SPCC plan with a <br /> date of 8/7/2020. Facility has a total of 14,230 gallons of petroleum storage on site. The following tanks were <br /> observed: <br /> -Two 6000 gallon double walled diesel tanks that are manifolded together <br /> -1000 gallon double walled used oil tank <br /> -1000 gallon double walled motor oil tank <br /> -120 gallon double walled motor oil tank <br /> -Two 55 gallon drums of motor oil <br /> REGULATION GUIDANCE: (g)The owner or operator of a qualified facility as defined in this subparagraph may <br /> self-certify his facility's Plan, as provided in § 112.6.A qualified facility is one that meets the following Tier I or Tier II <br /> qualified facility criteria: (1)A Tier I qualified facility meets the qualification criteria in paragraph (g)(2)of this section <br /> and has no individual aboveground oil storage container with a capacity greater than 5,000 U.S. gallons. (2)A Tier II <br /> qualified facility is one that has had no single discharge as described in § 112.1(b)exceeding 1,000 U.S. gallons or <br /> no two discharges as described in§ 112.1(b)each exceeding 42 U.S.gallons within any twelve month period in the <br /> three years prior to the SPCC Plan self-certification date, or since becoming subject to this part if the facility has <br /> been in operation for less than three years(other than discharges as described in § 112.1(b)that are the result of <br /> natural disasters, acts of war, or terrorism), and has an aggregate aboveground oil storage capacity of 10,000 U.S. <br /> gallons or less. <br /> CORRECTIVE ACTION: Ensure facility prepares and implements a fully compliant SPCC plan, or maintain <br /> compliance with the Tier I qualified facility requirements, as is applicable. Provide a corrective action statement and <br /> a copy of the PE certified SPCC plan to the EHD. <br /> This is a minor violation. <br /> 718 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br /> containers. <br /> OBSERVATION: The facility failed to furnish a secondary means of containment, such as a dike or catchment <br /> basin, sufficient to contain the capacity of the largest single compartment or container with sufficient freeboard to <br /> contain precipitation. The following containers were observed without secondary containment: <br /> -Two blue metal 55 gallon drums of motor oil were observed in the shop without secondary containment. A drain <br /> was observed in the shop floor. <br /> REGULATION GUIDANCE: (c)(11) Position or locate mobile or portable oil storage containers to prevent a <br /> discharge as described in§ 112.1(b). Except for mobile refuelers and other non-transportation-related tank trucks, <br /> you must furnish a secondary means of containment, such as a dike or catchment basin, sufficient to contain the <br /> capacity of the largest single compartment or container with sufficient freeboard to contain precipitation. <br /> CORRECTIVE ACTION: Provide adequate secondary containment for mobile or portable oil storage tanks.
