The diesel VMI line leak detector failed to detect a leak when tested. All line leak detectors shall be capable of detecting a 3-gallon per hour leak at 10 psi. The service technician adjusted the leak detector, retested it, and it passed. This was corrected on site. This is a minor violation. 319 CCR 2635, 2637.1, 2665, 2712 No spill bucket, failed to contain 5 gallons, no means to keep it empty, or failed to be tested. The diesel direct-bury spill container failed when tested. All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately, there is a possibility that the diesel UST system may be red tagged to prevent fuel inputs. This is a minor violation. 320 CCR 2635, 2637.2, 2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill prevention. Overfill prevention testing was conducted on January 25, 2019. This testing was required to be conducted by October 13, 2018. Ensure all future testing is conducted within required time frames. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by May 31, 2019. NOTE: The Owner/Operator Written Agreement section was not submitted in CERS. The facility is exempt from the requirement for an agreement. The reason for the exemption should be submitted in CERS.
