264, Subpart CC, have the meaning given to them in Section <br /> 265.1081, the Act, and parts 260-266 of Chapter I. Thus, the <br /> definition of a closed-vent system for the purpose of Part 264, <br /> Subpart CC, can be found in Part 264, Subpart AA. <br /> Must facility personnel be physically present at the transfer <br /> point during the delivery of product to an underground storage <br /> tank (UST) ? <br /> EPA does not require that facility personnel be physically <br /> present at the transfer point during the delivery of product to a <br /> UST. However, all deliveries of product to a UST must be <br /> monitored constantly (Section 280.30) . Facility personnel at the <br /> site, but not necessarily at the transfer point, must monitor <br /> transfers of the product to a UST. The use of remote sensing <br /> equipment that prevents spills and overfills may be used to <br /> satisfy this requirement (53 FR 37082, 37136; September 23, <br /> 1988) . <br /> Are wastewater treatment facilities required to prepare and <br /> implement a Spill Prevention Control and Countermeasure (SPCC) <br /> Plan? <br /> A facility, or part of a facility, used exclusively for <br /> wastewater treatment is not subject to SPCC requirements, as long <br /> as it is not used to satisfy any other requirement in Part 112 <br /> (Section 112.1(d) (6) ) . <br /> May local governments be reimbursed for emergency remedial <br /> actions? <br /> Any general purpose unit of local government for a political <br /> subdivision that is affected by a release may receive <br /> reimbursement for the costs of temporary emergency measures <br /> necessary to prevent or mitigate injury to human health or the <br /> environment subject to the conditions set forth in Part 310. <br /> Such reimbursement may not exceed $25,000 for a single response <br /> (Section 300.700(f) ) . <br /> How is information submitted pursuant to the reporting <br /> requirements under EPCRA Section 312 available to the public? <br /> All information obtained from an owner or operator in response to <br /> a request and any other requested Tier II form or MSDS otherwise <br /> in possession of the Commission or Committee can be made <br /> available to the person submitting the request. However, upon <br /> request of the owner or operator, the Commission or Committee <br /> will not disclose the location of any specific chemical <br /> identified in the Tier II form (Section 370.31) . <br /> Owners or operators of a facility subject to the risk management <br /> program regulations must include an EPA Facility Identifier <br /> number (EPA Facility ID) in their risk management plan (RMP) <br /> (Section 68.160(b) (8) ) . Is this ID number the same as a <br /> facility's RCRA ID number? <br /> The RMP Facility Identifier is a unique twelve-digit number that <br /> the RMP Reporting Center will assign to the facility after the <br /> initial RMP submission. The EPA Facility ID must be left blank <br />
