Application for the Beneficial Reuse <br /> of Fly Ash or Bottom Ash <br /> Bed Ash Liability Statement <br /> All bed ash, screened and unscreened, contains or potentially contains foreign materials, <br /> including but not limited to nails and other metals which can puncture tires and/or cause <br /> damages or injuries through handling. Itis the responsibility of the receiver of the material <br /> to safeguard persons and property from such damage. DTE Stockton, LLC("DTES")does <br /> not assume any liability for such damages. The receiver of the ash material shall <br /> indemnify and hold harmless DTES against and in respect of any and all claims, expenses <br /> (including, without limitation, reasonable attomeys'fees and costs of litigation), damages, <br /> deficiencies, or liabilities resulting from the receiver's procurement of any ash material. <br /> Ash produced by DTES is considered non-hazardous in accordance with Title 22 CCR <br /> Section 66261.120 and 66261.2. Routine analysis of all ash generated by DTES is <br /> performed, and the results of analysis are available for review. A Safety Data Sheet will <br /> be provided to all approved applicants prior to delivery of ash to the site. <br /> I have read and completed the application to the best of my knowledge. I acknowledge <br /> possibility of foreign material in the ash. I acknowledge that prior to receiving any ash <br /> material, a site visit will occur to ensure accuracy of the application.
