(b) The Zoning Ordinance establishes various classes of zones, prescribes <br /> land uses and regulations for the various zones, and adopts zoning maps for the <br /> purpose of dividing the County into zones and showing the zone boundaries; and <br /> (c) The Zoning Ordinance regulates the use of buildings, structures, and land, <br /> as between agriculture, industry, business, residence, and other purposes, and other <br /> uses more specifically set forth in Government Code section 65850; and <br /> (d) -Application has been made pursuant to provisions of section 19.104.040 <br /> of the Ordinance Code, and requests modification of a Conditional Use Permit (CUP), <br /> CUP No. 9, Map No. 28, approved on October 24, 2013, (for a Class III non-hazardous <br /> industrial waste landfill) to modify project boundaries and conditions to allow for the <br /> relocation of required monitoring equipment and adjustment in facility closure date in an <br /> A (Exclusive Agriculture) District; and <br /> (e) The application has been made in the form and manner prescribed by the <br /> Zoning Ordinance and is on file with the Clerk of this Board, and reference is made to it <br /> for further particulars; and <br /> (f) An Environmental Impact Report (EIR) relating to this project was <br /> prepared by the Planning and Community Development Department and was certified <br /> by this Board on April 1, 2008; and <br /> (g) The Clerk of this Board has caused notice to be given of a public hearing <br /> in this matter in accordance with law, as evidenced by the affidavit of publication and <br /> the affidavit of mailing on file with the Clerk of this Board; and <br /> (h) A copy of the report and recommendations of the Planning and <br /> CommunityDevelopment p t D epartment and the previously certified EIR have been on file <br /> in the Office of the Clerk of this Board, available for examination during regular <br /> business hours by any interested person at all times since the date of giving notice in <br /> this matter; and <br /> (i) The Director of the Planning and Community Development Department <br /> has furnished to this Board, and this Board has incorporated in the record of this matter, <br /> a document setting forth the significant environmental effects identified in the previously <br /> certified EIR, with proposed findings for consideration by this Board in relation to the <br /> significant effects for the purpose of Public Resources Code section 21081 and State <br /> CEQA Guidelines section 15091, and setting forth evidence in support of the proposed <br /> findings; and <br /> D <br /> Q) uring the hearing, this Board considered the adequacy and scope of the <br /> previously certified EIR and reviewed and considered the information contained with <br /> respect to the merits of the matters under consideration; and <br /> 2 <br />
