SAN J OAQU I N Environmental Health Department
CC LJ N T Y-------
Aboveground Petroleum Storage Act Inspection Report
Facility Name: Facility Address: Date:
RALPH HAYES&SON INC 20177 S MACARTHUR DR, TRACY September 22, 2020
SUMMARY OF VIOLATIONS
(CLASS I,CLASS II,or MINOR-Notice to Comply)
Item# Remarks
706 CFR 112.8(c)(2)Failed to provide and maintain adequate secondary containment.
OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations
sufficient to hold the capacity of the largest container, including adequate freeboard for precipitation. The two
approximately 200 gallon new oil and one approximately 100 gallon new oil tanks in the shop appear to be single
wall tanks without secondary containment.
REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations(except mobile refuelers and other
non-transportation-related tank trucks)so that you provide a secondary means of containment for the entire capacity
of the largest single container and sufficient freeboard to contain precipitation. You must ensure that diked areas are
sufficiently impervious to contain discharged oil. Dikes, containment curbs, and pits are commonly employed for this
purpose. You may also use an alternative system consisting of a drainage trench enclosure that must be arranged
so that any discharge will terminate and be safely confined in a facility catchment basin or holding pond.
CORRECTIVE ACTION: Immediately provide and maintain adequate secondary containment for the following bulk
storage tanks:Two approximately 200 gallon new oil tanks and approximately 100 gallon new oil tank. Submit proof
of correction to the EHD.
This is a Class II violation.
Overall Inspection Comments:
Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement
documenting the corrective actions that have been or will be taken for each violation, and any supporting
paperwork, by October 22, 2020.
To minimize person to person contact EHD is choosing to write the name of person receiving the report instead
of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate
($152). To schedule an appointment, please call (209)468-3420.
The following was observed during this inspection:
-10,000 gallon diesel tank
-1000 gallon gasoline tank
-500 gallon used oil tank
-Two approximately 200 gallon new oil tanks
-One approximately 100 gallon new oil tank
Empty tanks:
-500 gallon tank in berm
-Two approximately 500 gallon tanks in the back northwest corner of the property
-Approximately 13 saddle tanks in the back northwest corner of the property
The following was provided during this inspection: Schedule of free CUPA classes, Return to Compliance
certification, SPCC plan guidance document
FA0009323 PR0545958 SCO01 09/22/2020
EHD 28-01 Rev.9/16/2020 Page 5 of 6 Aboveground Petroleum Storage Act OIR
1868 E.
