Failed to determine if a waste is a hazardous waste: <br /> At time of inspection: <br /> According to Jose Gil,if a lead acid battery leaks the acid is absorbed with soda ash. The waste is than stored in an approximately 30 gallon plastic trash <br /> can. The waste has been on site since,at least,July 2010 according to Jose. Jose is unaware of what to do with the waste <br /> Immediately make a hazardous waste determination pursuant to Title 22 hazardous waste regulations or handle as hazardous waste. Within 30 days <br /> provide written documentation describing how this waste stream is being handled. <br /> 18,20. 1-55 gallon drum of waste absnt was seen missing the hazardous property with a start date of April 10,2010. The used oil container, <br /> approximately 250 gallons,was marked with the hazardous property"other". All hazardous waste containers shall be marked with the following information: <br /> 1.the words"Hazardous Waste" <br /> 2.name and address of generator <br /> 3.hazardous properties <br /> 4m physical state <br /> 5.composition(contents) <br /> 6.accumulation start date <br /> Immediately label these containers and ensure that all containers are marked with all the required information. According to the start accumulation date,the <br /> used absorbent has been on site longei than 90 days. Immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and <br /> submit a copy of the manifest to the EH D by March 11,2011. <br /> 23. 1-55 gallon drum of drained used o I filters was seen without a label. 1-55 gallon drum of drained used oil filters was seen with a hazardous waste label <br /> indicating the waste was used absorbe t. Used oil filters must be stored in a dosed,rainproof container,labeled as"drained used oil filters,"and marked <br /> with an accumulation start date. Faciliti s that generate up to one ton of used oil filters per year may store the filters up to one year. Immediately recycle <br /> these filters under a bill of lading and s mit a copy of the bill of lading to the EHD by March 11,2011. For future storage of filters begin label as described <br /> above. <br /> 45. Contingency plan incomplete: <br /> At time of inspection: <br /> The contingency plan on site was incorr plete. The contingency plan must include: <br /> 1. Description of actions facility personi let will take in response to fires,explosions,or any sudden or non-sudden release of hazardous waste to air,soil or <br /> surface water at the facility <br /> 2. Description of arrangements made ith local police departments,fire departments,hospitals,contractors and State and local emergency response teams <br /> to coordinate emergency services <br /> 3. List name,address,and phone numbers(office/home/cell)of all persons qualified to act as emergency coordinator. Where more than one person is <br /> listed,one shall be named as the prima emergency coordinator and all others in order in which they will assume responsibilities. <br /> 4. List all emergency equipment,which indudes location.physical description,and brief outline of its capabilities. <br /> 5. Evacuation routes for facility person I where there is a possibility of evacuation. <br /> 6. Current telephone number for State Ciffice of Emergency Services. <br /> If the facility has a Spill Prevention.Con rot and Countermeasures plan.or some other emergency or contirgency plan,the <br /> owner or aper ator meed only amend tha clan to incomorate hazardous waste management provisions that are sufficient to <br /> comply with the requirements of this chapter. immediately prepare or amend an existing plan to tuinii the requirements of this <br /> chapter.
