I acting by,through,under,or on behalf of Defendants and all persons in concert with or participating 2 with said Defendants with actual or constructive knowledge of this Injunction, only insofar as they 3 are doing business in the State of California and confined to Defendant's GASOLINE SALES/MINI- 4 MART activities in the County of San Joaquin and elsewhere in the State of California. 5 3. Defendants,with actual or constructive knowledge of this Injunction,only in so far as they 6 are doing business in the State of California, in the course of Defendants' GASOLINE 7 SALES/MINI-MART activities,pursuant to Health and Safety Code section 25299.01,are 8 permanently enjoined from: 9 a. Failing to perform periodic secondary containment tests, in violation of California 10 Code of Regulations,title 23 section 2637(a); I 1 b. Failing to submit a copy of the secondary containment test report to the local 12 agency within thirty(30)days of the test, in violation of California Code of Regulations,title 23 13 section 2637(e); 14 c. Failing to install and maintain monitoring equipment capable of detecting a leak at 15 the earliest possible opportunity, in violation of California Code of Regulations,title 23 section 16 2630(d); 17 d. Failing to equip all secondary containment, including under-dispenser 18 containment spill control or containment systems,with a continuous monitoring system, in violation 19 of California Code of Regulations,title 23 section 2636(f)(1); 20 e. Failing to maintain spill containers so that the spill containers contain a minimum 21 capacity of five(5) gallons, in violation of California Code of Regulations,title 23 section 22 2635(b)(1); 23 f. Failing to check that all required testing and maintenance for the underground 24 storage tank system have been completed, and document the dates these activities occur, in violation 25 of California Code of Regulations,title 23 section 2715(c)(5); 26 g. Failing to perform annual monitoring certification and leak detector testing, in 27 violation of California Code of Regulations,title 23 section 2638(a); 28 -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
