<br /> Custmner certifies that (i) the above-nel".11 mete'ials arra properly
<br /> classified, packaged, mmrAed and labeled, and are in Proper tend it ion
<br /> for transportation according to the applicable regulations of the
<br /> 0epartmeit of Transportation (ii) no material change has Occurred
<br /> either in the characteristics of the waste/Inateri4l or, in the process
<br /> ge Herat my the wa.teAdt-rial, and ('iii) the above referenced
<br /> Generator Status is torr act Customer agrees to pay the above charges
<br /> and to be bound by the terms and conditions (1) set forth in (a) the
<br /> General Terms and Conditions provided separately to Custmoer or (b)
<br /> any SK a0reement signed LY Customer and SK, and (2) 'incorporated
<br /> herein by reference. Unless otherwise indicated in the payment
<br /> rote ived section, SK is authorized to charge Custmner': account for
<br /> this transaction. If Cost-o-r fails to make payment when due, an
<br /> mmaunt equal to the lesser of (i) I.S% per month (18% per annun) or
<br /> (ii) the maximum mnount allowed by law, will be added to ail un Paid
<br /> .mounts outstanding. Customer certifies that tire individual signing
<br /> this Service Acknowledgement is duly authorized to sign and bind
<br /> Custommr. Customer acknowledges that it is responsible for nnaintaining
<br /> its Generator Status and obtaining an EPA IO number if required by
<br /> applicable law. The following provision is applicable to
<br /> Safety-Kleen's partscleaner and paint gun cleaner services: Custmner
<br /> agrees that it will not introduce any substance into the solvent or
<br /> aqueous cleaning solution, including without limitation any hazardous
<br /> waste or hazardous waste constituent, except to the extent such
<br /> introduction is incidental to the nonoral use of the machine, Customer
<br /> further agrees that it will not clean Pets/Paint �1IIOns that have been
<br /> contmoinated with o• otherwise introduce PolYchlorinated biphenyls
<br /> CPC0's), herbicides, Pesticides, dioxins or listed hazardous waste
<br /> into the solvent or aqueous cleaning solution. Safety-Kleen has tine -
<br /> capacity and is permitted to accept, store, and/or reclisho the spent
<br /> parts washer solvent; Paint thinners, solvents and paints generated by
<br /> customer; or dry cleaning filter cartridges, powder, and still
<br /> residues containing PerchlOroethyl else, petroleum naphtha, or
<br /> triflurotrichloroethane drycleaning solvents. Customer agrees that it
<br /> is responsible for proPerly cl ossifying ita^aste stremes as Used Oil
<br /> or Nonhazardous Waste in accordance with the provision of 40 CFR
<br /> 262.11 and applicable state laws. Customer agrees that it will not
<br /> introduce any non-conforming substance into the SK Property,
<br /> including, wi Lbuut limitation, any Ilazardous waste ur'Lazardoua was Le
<br /> constituent,(i.e., polychlorinated biphenyls ("PCBs"), herbicides,
<br /> pesticides, dioxins, or listed hazardous wastes) except to the extent
<br /> such introduction is incidental to the Oonnal use of the SK Property.
<br /> In the event of the introduction of such norconfoaing hazardous
<br /> waste, Customer agrees that it will be responsible for all costs and
<br /> remediat'im, expense, related to or arising-fion, rhe. grape, Inanagampnt
<br /> and disposal of the non-con funning waste, including tine cost of
<br /> equipment decontagdnation and subsequent disposal. Final invoicing
<br /> will be based on the actual services provided, which Inay include
<br /> additional charOes for offspecification waste and surcharges, Final

<br /> receipt. If any legal action is cournenced because of an alleged
<br /> dispute, breach, default or InisrePresentation- the Custmner also
<br /> agrees that the prevailing party will be entitled to recover
<br /> reasonable attorney's fees and.,costs associated with the
<br /> nun-conforming contmhination event. Safety-Kleen's failure to screen
<br /> Customer's material or take a retain sernple, in no way constitutes a
<br /> waiver of Custmner's obligation to properly classify its materials,
<br /> Safety-kleen relies on Customer's r epresertat i ens and Customer is
<br /> responsible for informing Safety-Kleen of any Prucess changes that "lay
