5 <br /> Accumulation start date <br /> Physical state <br /> Hazardous property <br /> Immediately properly label all containers storing hazardous waste. <br /> Violation #27-Failed to keep containers of HW closed except when adding/removing <br /> hazardous waste 66265.173(a) CCR. <br /> At time of inspection the clear plastic"ST"Tote was seen open. Hazardous waste containers <br /> must be kept closed at all times unless actively adding or removing hazardous waste. <br /> Immediately, close all storage containers of hazardous waste unless actively adding <br /> or removing hazardous waste. <br /> Violation #52-Proper waste handling and emergency procedures 40 CFR Section <br /> 262.34(d) (5) (iii). The generator must ensure that all employees are thoroughly <br /> familiar with proper waste handling and emergency procedures, relevant to their <br /> responsibilities during normal facility operations and emergencies. <br /> According to Store manager the only employees who receive hazardous waste training are the <br /> store managers, assistant store manager, shift supervisors and Pharmacists. "Front Store" <br /> employees do not receive the hazardous waste training. During working hours a person who has <br /> received training may not be on the schedule. Employees who have not received the training <br /> may be asked to respond to a spill on the floor. <br /> According to the "CVS photo waste management-California"document all spent photo filters shall <br /> be collected in the Photo State Regulated-Toxics Container. At time of inspection spent filters <br /> were being stored in the C-B hazardous waste tote. <br /> It was not demonstrated to the inspectors that hazardous waste management procedures had <br /> been provided to employees at this facility. <br /> Within 30 days, submit copies of hazardous waste training records for employees at <br /> this location. Include topics covered during this training. Immediately implement a <br /> training procedure for all employees who handle or respond to hazardous waste <br /> incidents and submit a copy of the procedure to this office. <br /> Violation #999-Generators responsibility to classify a waste as Hazardous or <br /> Nonhazardous 66260.200(c). <br /> At time of inspection, hazardous waste is being individually wrapped in plastic bags labeled <br /> "potentially hazardous waste" and than stored in totes labeled "Hazardous waste pending further <br /> evaluation". On 4 totes, C-B, AF, OX, and RX, the words "Hazardous waste pending further <br /> evaluation" were on the labels. On 3 totes, ST, C-A, and C-B, the words "hazardous waste <br /> pending further evaluation" was scratched out on the labels. On the Photo tote the statement <br /> was missing. <br /> Immediately begin classifying waste as hazardous or nonhazardous pursuant to Title <br /> 22 hazardous waste regulations and handle accordingly or handle as hazardous <br /> waste. Within 30 days provide written documentation describing how waste is being <br /> handled <br /> Within 30 days, complete and submit a copy of the Return to Compliance <br /> Certification, found on the back of page 1, with a statement addressing how each of <br /> the above listed violations have been corrected, Submit all requested and necessary <br /> supporting documentation. <br /> 5 EHD Inspector Received b <br />
