CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> RESOLUTION NO. - T <br /> WAIVER OF <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR r= <br /> THE O. M. SCOTT AND SONS COMPANY, HYPONEX CORPORATION <br /> REGIONAL COMPOSTING FACILITY 1E <br /> SAN JOAQUIN COUNTY <br /> WHEREAS, Section 13260(a) of the California Water Code requires that any person <br /> discharging waste or proposing to discharge waste within any region, other than to a N <br /> community sewer system that could affect the quality of the waters of the State, shall file a <br /> report of waste discharge; and <br /> WHEREAS, Section 13263(a) of the California Water Code requires the California <br /> Regional Water Quality Control Board (Regional Board) to prescribe requirements as to the T <br /> nature of existing and proposed discharges in its respective area of jurisdiction; and <br /> WHEREAS, California Code of Regulations, Title 23, Division 3, Chapter 15, <br /> commencing with Section 2510 contain requirements governing discharges of waste to land; <br /> and A <br /> WHEREAS, the Regional Board has received a Report of Waste Discharge, dated <br /> 22 December 1994, from the O. M. Scott and Sons Company, Hyponex Corporation (Scotts) <br /> for a green waste composting facility; and T <br /> WHEREAS, green waste composting will be the principal activity on site and the <br /> facility will only accept material delivered by municipal and commercial haulers and will not <br /> be open to the general public; <br /> WHEREAS, the facility is designed to accept and process residential and commercial <br /> yard trimmings to produce compost and mulch for use in the manufacturing of lawn care <br /> products at their adjacent blending and bagging plant; and <br /> WHEREAS, the California Integrated Waste Management Board has adopted <br /> regulations for green waste composting facilities; and V <br /> WHEREAS, "green waste" means waste consisting of plant material which is derived <br /> from leaves, grass clippings, weeds, tree trimmings, residential or community garden wastes, <br /> untreated wood waste, or shrubbery cuttings; and E <br /> WHEREAS, "green composting facility" means a facility that is operated for the <br /> purpose of producing compost from the green material fraction of the waste stream: and <br />
