S A N J D AR I N Environmental Health Department <br /> (L)j ;"� i Y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ECLIPSE METAL FABRICATION 1 17700 SHIDELER PKWY, LATHROP October 12, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS:The following were observed in the metal grinding area: <br /> -Metal fines observed in the metal grinding area. Operator stated that metal dust is sent to scrap metal recyclers. <br /> The following were observed in the laser cutting machine area: <br /> -Metal fines observed accumulating in container underneath laser cutting machine. Operator stated that metal fines <br /> are managed as scrap metal. <br /> Note: The following metals are used at this business: Stainless steel, aluminum metal strips and carbon steel. <br /> Safety data sheets for carbon steel has warning that dust/fumes are suspected to cause cancer via inhalation, also <br /> stated under environmental precaution-"may contain reportable quantities of alloying elements."Stainless steel <br /> Safety data sheet stated that product contains chromium and nickel components and trace amounts of arsenic, <br /> cadmium, cobalt and lead. <br /> Alco Scrap metal recycler picks up metal fines as scrap metal. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if <br /> the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as <br /> scrap metal. <br /> CORRECTIVE ACTION: Immediately, stop recycling of metal fines, make a hazardous waste determination for <br /> each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test <br /> results or other knowledge to make your hazardous waste determination. Waste testing must be done using <br /> methods specified in Title 22 CCR including Title 22 CCR sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 11-11-2020. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
