The HSC section 25250.1(b)(1)(B) <br /> exemption requires the oil generator to demonstrate that the oil is not hazardous for any characteristic or constituent <br /> OTHER than those listed in HSC 25250.1(a)(3)(B). <br /> This facility has not provided the hazardous waste determination documentation to satisfy the HSC 25250.1(a)(3)(B) <br /> requirement including Title 22 California Code of Regulations(CCR)section 66261.24 regulatory limits for toxicity. <br /> REGULATION GUIDANCE: HSC 25250.1(b) Unless otherwise specified, used oil that meets either of the following <br /> conditions is not subject to regulation by the department: <br /> (1)The used oil has not been treated by the generator of the used oil,the generator claims the used oil is exempt <br /> from regulation by the department, and the used oil meets all of the following conditions: <br /> (A)The used oil meets the standards set forth in subparagraph (B)of paragraph (3)of subdivision (a). <br /> (B)The used oil is not hazardous pursuant to the criteria adopted by the department pursuant to Section 25141 for <br /> any characteristic or constituent other than those listed in subparagraph (B)of paragraph (3)of subdivision (a). <br /> Title 22 CCR 66262.40(c)A business operator shall keep records of any hazardous waste determinations made in <br /> accordance with California Code of Regulations(CCR)section 66262.11 for at least three years from the date that <br /> the waste was last sent to an on-site or off-site treatment, storage,or disposal facility. The records may include <br /> Safety Data Sheets (SDS),waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the HCUO and maintain <br /> a copy in the facility file. <br /> Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous <br /> waste determination.
