1.0 Introduction <br /> The BNSF Railway Company (BNSF) is the second-largest freight railroad network in North <br /> America and is among the top transporters of intermodal freight in North America. <br /> Headquartered in Fort Worth, Texas, BNSF is a wholly-owned subsidiary of Berkshire <br /> Hathaway, Inc. <br /> BNSF operates various facilities to support its transportation system. These facilities include <br /> yards and terminals, system locomotive shops (for locomotive service and maintenance), and <br /> transfer facilities. BNSF owns and operates nearly 7,000 locomotives and regular inspection, <br /> maintenance, and testing of the locomotives is performed in accordance with BSNF and Federal <br /> Railroad Administration (FRA) regulations at eleven system locomotive shops. <br /> This transmittal represents a hazardous waste variance application for used oil submitted <br /> pursuant to the California Health and Safety Code (H&SC) Section 25143, which authorizes the <br /> Department of Toxic Substances Control (DTSC) to grant variances from one or more of the <br /> requirements in California Health and Safety Code (HSC), Division 20, Chapter 6.5 or <br /> regulations in California Code of Regulations (22 CCR), Title 22, Division 4.5, Chapter 11, for <br /> the management of a hazardous waste.. The hazardous waste that would be subject to this <br /> variance is used oil generated during maintenance of locomotives, rail-bound and off-road <br /> vehicles. <br /> The remaining portions of Section 1.0 provide an overview of the BNSF facility operations and <br /> the relative quantities of used oil generated at these facilities. <br /> Section 2.0 provides identifying information that relates to the primary BNSF and consultant <br /> contacts and details regarding the individual facilities for which this variance would apply. <br /> Section 3.0 presents an overview of the basis for the requested variance and information that is <br /> intended to form the framework to support the general basis for the variance. <br /> Section 4.0 identifies the specific statutory and regulatory requirements for which the variance is <br /> intended to address. <br /> Section 5.0 describes the hazardous waste management requirements that would be addressed <br /> by the waiver. <br /> Section 6.0 identifies specific conditions, limitations, and other requirements that would be <br /> addressed as a condition of the waiver. <br /> BNSF anticipates that following the review of this submittal, additional clarifications and <br /> adjustments to the form of the variance applications will be discussed. Among the issues to be <br /> addressed is a determination of scope and scale of the variance application and whether <br /> separate variance applications would be required for each BNSF facility. Regardless of the <br /> outcome of these future discussions, this submittal provides a general overview of the rationale <br /> and basis for the variance application, identifies specific statutory and regulatory requirements <br /> that would be addressed by the variance, describes additional sampling and analysis of used oil <br /> at representative BNSF facilities, and specifies additional management requirements that would <br /> continue to apply to the management of used oil. <br /> Hazardous Waste Variance Application 1 July 29, 2014 <br /> BNSF Railway <br /> TRC Project No. 211983 <br />
