Resources Control Board (SWRCB) and/or a California Regional Water Quality Control <br /> Board (RWQCB). <br /> b) The waiver in the variance shall only apply to used oil that is generated from facility <br /> operations and maintenance of locomotives, rail-bound and off-road equipment. The <br /> variance is not applicable to any other hazardous waste. <br /> c) In lieu of uniform hazardous waste manifests, BNSF will manifest recycled used oil <br /> under a bill-of-lading. The bill of lading will contain 1) the US DOT description including <br /> shipping name, hazard class and ID number, 2) handling codes, 3) quantity of material, <br /> 4) date of shipment, 5) origin and destination of shipment, and 6) any specific handling <br /> instructions. <br /> d) Transportation of used oil subject to the variance will be provided only by a registered <br /> hazardous waste transporter. <br /> e) Used oil will be transported to an authorized recycling facility. If the recycling facility is <br /> located outside of California, the facility will be authorized under the statutes and <br /> regulations of the state in which the facility is located. <br /> f) BNSF will maintain copies of all bills-of-lading for a period of not less than three years <br /> and will prepare an annual summary of the quantity of recycled used oil generated from <br /> each BNSF facility. These records shall be made available to DTSC upon request. <br /> g) BNSF will maintain copies of testing records provided by the recycling facility to <br /> demonstrate that the used oil meets the standards of purity and is not subject to <br /> regulation as a hazardous waste under the federal act. These records shall be made <br /> available to DTSC upon request. <br /> h) Above-ground storage tanks and containers containing used oil will be labeled as Non- <br /> Hazardous Waste, Used Oil. <br /> i) BNSF will perform inspections of above-ground storage tanks and containers containing <br /> used oil in accordance with the requirements of the Above Ground Petroleum Storage <br /> Act and Spill Prevention, Control and Countermeasure requirements. <br /> j) BNSF will store and handle used oil in accordance with all local ordinances and codes, <br /> including, but not limited to fire codes governing the storage and handling of the <br /> hazardous material. <br /> 7.0 Definitions <br /> Used Oil — Any oil that has been refined from crude oil, or any synthetic oil, that has been used <br /> and as a result of such use, is contaminated by physical (metal shavings, dirt) or chemical <br /> (solvents, water) impurities.
