0 0 <br /> THEREFORE, PURSUANT TO PUBLIC RESOURCES CODE DIVISION 30 AND <br /> CALIFORNIA CODE OF REGULATIONS, TITLE 27, DIVISION 7, YOU ARE <br /> HEREBY ORDERED TO: <br /> 1. Submit corrective action plan to this LEA by December 1St,2004. <br /> 2. The corrective action plan shall include gas control remediation for the site, and shall <br /> describe what actions will be taken to bring the site into compliance. <br /> 3. The corrective action plan must be implemented within 90 days of approval no later <br /> than April 2nd,2005. <br /> 4. Continue routine methane gas monitoring program. The monitoring program shall <br /> include, but not limited to, the evaluation of the existing gas monitoring probes and the <br /> concentration of landfill gas in ambient air at ground surface. The minimum frequency <br /> of monitoring shall be quarterly. <br /> 5. Submit gas monitoring reports to this LEA in accordance with the following <br /> schedule: <br /> Monitoring Period Reporting Deadline <br /> January-March April 30 <br /> April-June July 30 <br /> July-September October 30 <br /> October-December January 30 <br /> The owner is directed to maintain the concentration of methane gas at the boundary below the <br /> lower explosive limit(5%by volume). <br /> PLEASE TAKE FURTHER NOTICE: <br /> A. Pursuant to Section 44307 of Public Resources Code (PRC),the owner/operator have the <br /> right to request a hearing before the Solid Waste Independent Hearing Panel in regards to <br /> this Notice and Order within 15 days of receipt of this Notice and Order. <br /> B. Failure to correct the above violation could result in a civil penalty not to exceed ten <br /> thousand dollars ($10,000) for each day the violation occurs, as cited in PRC 45023 or in <br /> the suspension or revocation of the solid waste facility permit as cited in PRC 44305 and <br /> 44306. The Tandy Corporation may also be subjected to a civil penalty, to be imposed <br /> administratively by the LEA, not to exceed five thousand dollars ($5,000) for each day <br /> the violation occurs,as cited in PRC 45011(a). <br /> Notice and Order 04-01 Page 5 of 7 World Enterprises Site <br /> October 25,2004 <br />
