10.0 Security — 40 CFR 112.7(g) <br />The KRC TRACY PLANT is fenced, and the entrance driveway has a lockable gate. Workers <br />are present during normal business hours when gate is open. Each tank's dispenser and <br />fittings are accessible and are protected from direct impacts. The starter control for each <br />dispensing pump is controlled by a keyed device and is disconnected from within the control <br />building during non -attended periods to minimize the spill potential associated with the tank <br />system. <br />The fueling area has lighting adequate to allow for the discovery of a spill during non daylight <br />hours. <br />A Private security service monitors the secured facility during non working hours. <br />11.Q Facility Loading/Unloading Rack — 4Q CFR 112.7(h) <br />No tank truck or tank car loading or unloading rack is present at the KRC TRACY PLANT, <br />12.0 Brittle Fracture Evaluation — 40 CFR 1121(i) <br />The KRC TRACY PLANT does not have any field -constructed ASTs; therefore, brittle fracture <br />evaluation is not applicable. <br />13.0 Conformance with State and Local Applicable <br />Requirements -40 CFR 11210) <br />Bulk storage tanks at this facility are to be registered with state and local authorities as required <br />by California Health and Safety Code. Section 25270 known as the Aboveground Petroleum <br />Storage Act (APSA). Per section 25270.6.(a) (1) On or before January 1, 2009 and on or before <br />January 1 annually thereafter, each owner or operator of a tank facility subject to the APSA shall <br />file with the UPA a tank facility statement that shall identify the name and address of the tank <br />facility, a contact person for the tank facility, the total storage capacity of the tank facility, and <br />the location, size, age, and contents of each storage tank that exceeds 10,000 gallons in <br />capacity and holds substance containing at least 5 percent of petroleum. (2) Not withstanding <br />paragraph (1), an owner or operator of a tank facility that submits a business plan as defined in <br />subdivision (e) of Section 25501, to the UPA and that complies with Sections 25503.5, 25505 <br />and 25510, satisfies the requirement in paragraph (1) to file a tank facility statement. <br />Each year commencing in calendar year 2010, each owner or operator who is subject to the <br />above requirement shall pay a fee to the UPA <br />The facility is permitted under the California General industrial Storm Water Permit for discharge <br />of non -process storm water and will maintain a current Storm Water Pollution Prevention <br />Program. An annual report to the applicable Regional Water Control Board and payment of a <br />fee to the California Water Quality Control Board is required. <br />14 <br />
