A N J O A Q U IN Environmental Health Department <br /> COUNTY— <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PLATINUM HYUNDAI OF TRACY 3480 NAGLEE RD, TRACY November 18, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 510 CCR 66265.197 Failed to properly close a hazardous waste tank system. <br /> OBSERVATION: This facility has a hazardous waste tank that has not been closed in compliance with this section. <br /> -One 200-gallon tank with a waste antifreeze label observed with approximately one inch of unknown liquid/inside <br /> located outside in the north side of the business. <br /> Note: Operator stated that 200-gallon tank came from a different dealership that has since been closed down. <br /> REGULATION GUIDANCE: <br /> Title 22 California Code of Regulations (CCR)section 66262.34(a)(1)(A) <br /> The waste is placed in tanks and the generator complies with articles 10, 27, 28, and 28.5 of chapter 15 of this <br /> division, except sections 66265.197(c)and 66265.200. In addition, such a generator is exempt from all the <br /> requirements in articles 7 and 8 of chapter 15 of this division, except for sections 66265.111 and 66265.114. <br /> Title 22 CCR section 66265.111 <br /> The owner or operator shall close the facility in a manner that: <br /> (a)minimizes the need for further maintenance, and <br /> (b)controls, minimizes or eliminates, to the extent necessary to protect human health and the environment, <br /> post-closure escape of hazardous waste, hazardous constituents, leachate, contaminated rainfall or run-off, or <br /> waste decomposition products to the ground or surface waters or to the atmosphere <br /> Title 22 CCR section 66265.114 <br /> During the partial and final closure periods, all contaminated equipment, structures and soil shall be properly <br /> disposed of, or decontaminated by removing all hazardous waste and residues, unless specified otherwise in <br /> sections 66265.197, 66265.228, 66265.258, 66265.280, or 66265.310. By removing all hazardous wastes and <br /> residues or hazardous constituents during partial and final closure,the owner or operator may become a generator <br /> of hazardous waste and shall handle that hazardous waste in accordance with all applicable requirements of <br /> chapter 12 of this division. <br /> Title 22 CCR section 66265.197 <br /> (a)At closure of a tank system, the owner or operator shall remove or decontaminate all waste residues, <br /> contaminated containment system components (liners, etc.), contaminated soils, and structures and equipment <br /> contaminated with waste, and manage them as hazardous waste, unless section 66261.3(d)of this division applies. <br /> (b) If the owner or operator demonstrates that not all contaminated soils can be practicably removed or <br /> decontaminated as required in subsection (a)of this section,then the owner or operator shall close the tank system <br /> and perform post-closure care in accordance with the closure and post-closure care requirements that apply to <br /> landfills(section 66265.310). In addition,for the purposes of closure, post-closure, and financial responsibility, such <br /> a tank system is then considered to be a landfill, and the owner or operator shall meet all of the requirements for <br /> landfills specified in articles 7 and 8 of this chapter. <br /> CORRECTIVE ACTION: Please remove all contents from 200-gallon waste antifreeze tank.
