OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three years during the inspection. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years[DATE RANGE]for all hazardous waste including [LIST HW WE OBSERVED ONSITE OR KNOW ABOUT]. Provide these records and a corrective action statement to the EHD within 30 days. This is a Class II violation. 111 CCR 66262.42(a)(c)(d)Failed to comply with uniform hazardous waste manifest exception requirements. OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (U HWM): 019436514JJK 08/16/2018 REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by December 18, 2020.
