Phase I ESA Proposal and Scope of Work <br /> CATX Partners,LLC <br /> Page 4 of 4 <br /> LIMITATIONS <br /> The purpose of a Phase I ESA is not to prove that no hazardous materials are present at the Site, but it is <br /> intended to assist the Client with appropriate inquiry into the previous ownership and uses of the property <br /> to satisfy this element of the LLPs to Comprehensive Environmental Response, Compensation and <br /> Liability Act (CERCLA) liability. The use of an environmental professional will minimize and manage <br /> the risk of environmental difficulty,but it cannot completely eliminate the risk. <br /> Condor will not warrant or certify that the Site is free of contaminants,because it is impossible to know if <br /> such a condition exists. Contaminants may be present in areas that are not accessible for inspection or <br /> sampling. Contaminants can migrate later into areas that are inspected or sampled during the ESA. A <br /> prudent and professional consultant can only supply an opinion and cannot certify that certain conditions <br /> exist when it is impossible to know that such conditions exist. <br /> QUALIFICATIONS <br /> Condor has over three decades of aggregate experience in the performance of Phase I ESAs and <br /> environmental audits for financial institutions, attorneys, private companies and public agencies. <br /> Experienced environmental professionals perform assessments and audits that provide a standard of care <br /> consistent with industry practice and employ guidelines developed by the ASTM Practice E 1527-13. <br /> Alexander Dewitt, California Professional Geologist (#7502) is the Environmental Professional who will <br /> perform this assessment out of our Stockton office. Alexander Dewitt has over 18 years of experience <br /> conducting environmental assessments in California for public agencies and private industry. <br /> ESTIMATED SCHEDULE <br /> Condor will commence Site assessment activities upon receipt of a signed contract for this work. Condor <br /> will complete the Scope of Work as chosen on the Work Order.
