PHASE I <br /> ENVIRONMENTAL SITE ASSESSMENT REPORT <br /> NEIGHBORHOOD E <br /> 20001,20043,20501,AND 20601 <br /> MOUNTAIN HOUSE PARKWAY <br /> PORTIONS OF ASSESSOR'S PARCELS <br /> 209-050-06,209-050-02,209-050-07,AND 209-050-04 <br /> TRACY,SAN JOAQUIN COUNTY <br /> CALIFORNIA <br /> October 25,2001 <br /> 1.0 INTRODUCTION <br /> Trimark Communities, Inc. (Client) retained Condor Earth Technologies, Inc. (Condor) to conduct an <br /> American Society for Testing and Materials (ASTM) Standard E 1527-00 Phase I Environmental Site <br /> Assessment (ESA) for portions of the properties (Site) designated by Assessor's Parcel Numbers (APN) <br /> 209-050-06, 209-050-02, 209-050-07, and 209-050-04, located at 20001, 20043, 20501, and 20601 <br /> Mountain House Parkway (respectively), in Tracy, California (Figures 1 and 2, Appendix A). The Site <br /> consists of approximately 294 acres and is being considered by the Client for residential development. <br /> This Phase I ESA was performed in accordance with ASTM E 1527-00, Standard Practice for <br /> Environmental Site Assessments: Phase I Environmental Site Assessment Process. Included in this report <br /> is a discussion of the purpose and scope of work of iile assessment; a description of the Site and ui <br /> adjacent properties; a discussion of the information gathered from records; interviews and Site visits; and <br /> Condor's findings and conclusions. All figures referenced in the report are included in Appendix A. The <br /> results of research into ASTM-recommended government databases, conducted by Environmental Data <br /> Resources, Inc. (EDRO), are contained in Appendix B. Site photographs are contained in Appendix C. <br /> Site inspection questionnaires are located in Appendix D. Aerial photos and historical topographic maps <br /> provide by EDR® are located in Appendix E. A copy of the Preliminary Title Report supplied by Trimark <br /> Communities, Inc. is included in Appendix F. Copies of Pesticide Use Reports obtained from the San <br /> Joaquin County Agricultural Commissioner's Office are contained in Appendix G. The glossary of terms <br /> associated with an ASTM Phase I ESA is contained in Appendix H. <br /> 1.1 PURPOSE <br /> The purpose of the ASTM Phase I ESA is to conduct an appropriate inquiry into the previous ownership <br /> and uses of the property to help in partially satisfying the innocent landowner defense to Comprehensive <br /> Environmental Response, Compensation and Liability Act (CERCLA) liability and to identify "potential <br /> environmental conditions that could materially impact the operation of the business associated with the <br /> parcel of commercial real estate"(ASTM Standard Practice E 1527-00, Section 5.5). The goal of the ESA <br /> is to identify recognized environmental conditions and historical recognized environmental conditions. <br /> The term recognized environmental condition means the presence, or likely presence, of hazardous <br /> substances or petroleum products on a property under conditions that indicate an existing release, a <br /> past release, or a material threat of a release of hazardous substances or petroleum products into <br /> structures on the property or into the ground, groundwater or surface water of the property. The term <br /> includes hazardous substances or petroleum products even under conditions in compliance with laws. <br /> The term is not intended to include de minimis conditions that generally do not present a material risk <br /> 4) CONDOR <br />
