SAN J O A Q U I N Environmental Health Department <br /> -COUNTY <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Yardscape Construction Inc 1 1115 E JACKSON ST, STOCKTON August 11, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS 11,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION:This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control(DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat,store,dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID)Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION:Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: The following wastes were observed from the previous business: <br /> -In the back of the main warehouse,a pile of dust and other debris was generated from the cleanup of the previous <br /> business. <br /> -In the center yard between the warehouses,one blue 55 gallon drum(1/2 full)contained an unknown solid from the <br /> previous business. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic,corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste, and manage it <br /> according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to <br /> support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR <br /> including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
