Weber Ave. <br /> Stockton, CA 95205 <br /> NOTICE OF VIOLATION, IDSS OF LIABILITY OMW.GE POLICY #CT00188-1 <br /> TRANSPORTER REGISTRATION NO. 0178 <br /> Your insurance company has notified this office of the cancellation of your <br /> liability insurance for transporting hazardous waste. Pursuant to <br /> Section 66450(b) , Title 22, California Code of Regulations (22 CCR) , you were <br /> required to notify the Department, in writing, immediately upon notice to you of <br /> loss of your liability cover-age, and you have not done so. <br /> Section 25169(a) , California Health and Safety (H&S) Code, requires you, as a <br /> transporter of hazardous waste, to maintain ability to respond in damages <br /> resulting from the operation of your business. Therefore, in accordance with <br /> Section 66450, 22 CCR, you shall cease transporting hazardous waste immediately. <br /> Transportation of hazardous waste in violation of Section 66450 may subject you <br /> to severe civil and criminal sanctions and/or loss of your registration as a <br /> hazardous waste transporter. <br /> Pursuant to Section 25169(b) , H&S Code, the Department is hereby notifying you <br /> of this violation. You must respond by submitting proof of insurance within 30 <br /> days of transmittal of this notice or the Department shall automatically suspend <br /> your transporter's registration; YOU WILL NOT RECEIVE A SEPARATE NOTICE OF <br /> SUSPENSION. <br /> If you have obtained new liability coverage, forward the enclosed DHS 8038 to <br /> your insurance company to complete and return to us or request your insurance <br /> ccq:)any to send us a Form MCS-90 endorsement. If your former policy has been <br /> reinstated, submit your insurance company's notice of reinstatement to this <br /> office. If you meet any of these requirements within 30 days, you may then <br /> resume the transportation of hazardous waste. If you have cancelled your <br /> insurance and do not intend to transport hazardous waste any longer, please <br /> notify us. <br /> If such proof of compliance is not submitted within 60 days of the transmittal <br /> of this notice of violation, your registration shall immediately be revoked. <br />
