All local measures would have been adopted by the SJVAPCD before 2012. This plan was <br />approved by the EPA on April 30, 2012. On November 26, 2012, however, the EPA withdrew its determination that <br />the plan satisfied the federal Clean Air Act requirements regarding emissions growth caused by growth in vehicle <br />miles traveled. All other determinations in the EPA’s March 1, 2012, rule app roving the plan remain unchanged <br />and in effect. The SJVAPCD is currently in the process of developing an O 3 plan to address EPA’s 2008 8-hour O3 <br />standard, with attainment required by 2032. <br />2009 Reasonably Available Control Technology State Implementation Plan <br />On April 16, 2009, the Governing Board adopted the Reasonably Available Control Technology Demonstration for <br />Ozone State Implementation Plans (2009 RACT SIP) (SJVAPCD 2009). In part, the 2009 RACT SIP satisfied the <br />commitment by the SJVAPCD for a new RACT analysis for the 1-hour O3 plan (see discussion of the EPA withdrawal <br />of approval in the Extreme 1-Hour Ozone Attainment Demonstration Plan summary above) and was intended to <br />prevent all sanctions that could be imposed by the EPA for failure to submit a required SIP revision for the 1-hour <br />O3 standard. With respect to the 8-hour standard, the plan also assesses the SJVAPCD’s rules based on the adjusted <br />major source definition of 10 tons per year (due to the SJVAB’s designation as an extreme O3 nonattainment area), <br />evaluates SJVAPCD rules against new Control Techniques Guidelines promulgated since August 2006, and reviews <br />additional rules and rule amendments that had been adopted by the Governing Board since August 17, 2006, for <br />RACT consistency. <br />2013 Plan for the Revoked 1-Hour Ozone Standard <br />The SJVAPCD developed a plan for EPA’s revoked 1 -hour O 3 standard after the EPA withdrew its approval of <br />the 2004 Extreme 1 -Hour Ozone Attainment Demonstration Plan as a result of litigation. As a result of the <br />litigation, the EPA reinstated previously revoked requirements for 1 -hour O3 attainment plans. The 2013 plan <br />addresses those requirements, including a demonstration of implementation of reasonably available control <br />measures and a demonstration of a rate of pro gress averaging 3% annual reductions of ROG or NO x emissions <br />every 3 years. The 2013 Plan for the Revoked 1 -Hour Ozone Standard was approved by the Governing Board <br />on September 19, 2013 (SJVAPCD 2013). <br />2014 RACT SIP <br />On June 19, 2014, the Governing Board adopted the 2014 Reasonably Available Control Technology Demonstration <br />for the 8-Hour Ozone State Implementation Plan (2014 RACT SIP) (SJVAPCD 2014a). Th e 2014 RACT SIP includes <br />a demonstration that the SJVAPCD rules implement RACT. The plan reviews each of the NOx reduction rules and <br />concludes that they satisfy requirements for stringency, applicability, and enforceability, and meet or exceed RACT. <br />The plan’s analysis of further ROG reductions through modeling and technical analyses demonstrates that added <br />ROG reductions will not advance SJVAB’s O3 attainment. Each ROG (i.e., VOC) rule evaluated in the 2009 RACT SIP, <br />however, has been subsequently approved by the EPA as meeting RACT within the last 2 years. The O 3 attainment <br />strategy, therefore, focuses on further NOx reductions. <br />SJVAPCD 2016 Plan for the 2008 8-Hour Ozone Standard <br />The SJVAPCD adopted the 2016 Plan for the 2008 8-Hour Ozone Standard in June 2016. This plan demonstrates <br />the practicable and expeditious attainment of the 75 parts per billion 8-hour O3 standard (SJVAPCD 2016a).
