f <br /> waterways, is prohibited. <br /> CHAPTER 2 . ENFORCEMENT <br /> SECTION 5-9200 . ENFORCEMENT. <br /> It shall be the duty of the Director of Environmental Health <br /> or his designee to enforce the provisions of this Division. <br /> SECTION 5-9201. RIGHT OF ENTRY. <br /> Whenever necessary to make an inspection to enforce any of the <br /> provisions of this Division, or whenever the Director of <br /> Environmental Health or his designee has reasonable cause to <br /> believe that there exists upon any premises any condition which <br /> constitutes a violation of the provisions of this Division, he may <br /> enter such premises to inspect the same or perform any duty imposed <br /> upon him by this Division. Prior to making such entry, if the <br /> premises is occupied, he shall first present proper credentials and <br /> obtain consent to enter. If such premises be unoccupied, he shall <br /> first make a reasonable effort to locate the owner or other persons <br /> having charge or control of the premises and request entry. When <br /> requesting consent to enter the premises pursuant to this section, <br /> he shall inform the property owner or occupant that he has the <br /> right to refuse entry and that in the event such entry is refused, <br /> issuance of an inspection warrant by a duly authorized magistrate <br /> may be sought . If the owner and/or occupant refuses entry after <br /> such request has been made, the Director of Environmental Health or <br /> his designee is hereby empowered to seek assistance from any court <br /> of competent jurisdiction in obtaining such entry. <br /> 3 <br />
