S A N J D AR I N Environmental Health Department <br /> UU ;,�J i Y <br /> Underground Storage Tank Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> RIVER POINT LANDING MARINA-RESORT* 4950 BUCKLEY COVE WAY, STOCKTON January 22, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 108 CCR 2620(b); HSC 25284(a)(3)Failure to implement or maintain a written agreement between the UST owner and <br /> operator. <br /> OBSERVATION: The annual operating permit is not issued to the current operator and there is no written <br /> agreement between the person who was issued the permit and the operator to monitor the UST system, since <br /> Andrew Rehberg is no longer the tank operator. <br /> REGULATION GUIDANCE: If a permit is issued to a person other than the operator of the tank, that person shall <br /> enter into a written agreement with the operator of the tank to monitor the UST system. <br /> CORRECTIVE ACTION: Immediately upload the written agreement to the California Environmental Reporting <br /> System (CERS)and submit for review by the EHD. <br /> This is a minor violation. <br /> 308 CCR 2632(c), 2634(d), 2636(f) Failure of the leak detection equipment to have an audible and visual alarm. <br /> OBSERVATION: The float and chain in the diesel UDC failed to stop the flow of product at the dispenser when <br /> tested. <br /> REGULATION GUIDANCE:All monitoring equipment shall be maintained to activate an audible and visual alarm or <br /> stop the flow of product at the dispenser when it detects a leak. <br /> CORRECTIVE ACTION: The service technician adjusted the float and chain and verified functionality. <br /> --------------------------------------------------------------------------------------------------------------- <br /> OBSERVATION: The float and chain in the 89 UDC failed to stop the flow of product at the dispenser when tested. <br /> REGULATION GUIDANCE:All monitoring equipment shall be maintained to activate an audible and visual alarm or <br /> stop the flow of product at the dispenser when it detects a leak. <br /> CORRECTIVE ACTION: Correct immediately by having a properly licensed,trained, and certified contractor replace <br /> the failed component with a functional component(LG 113-x listed, if applicable), and obtain a permit within one <br /> business day from the EHD, if needed. If the failed component can't be replaced immediately,there is a possibility <br /> that the 89 and diesel UST system may be red tagged to prevent fuel inputs. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, 2/21/2021. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
