ED A violation that is causing , or threatens to cause a liquid release of petroleum from an underground storage tank system , including , but not limited to : the failure of any required overfill prevention system , where the failure is causing or threatens to cause a release ; or the failure of a required spill containment structure , where the failure is causing or threatens to cause a release to the environment due to a spill or an overfill . ❑ A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law . ❑ A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action ) . -An inspection was last conducted on 11 /03/2021 and an inspection report was issued identifying information to be submitted to bring this site int compliance . The violations include but are not limited to the following : -The 87 and 91 tanks do not have an overfill prevention system . The facility's tank information forms for the two tanks state that site is using ball floats as the only means of overfill protection . The facility has single walled vent piping , therefore , can not use ball floats as the only means of overfill protection . - Failure to comply with overfill prevention equipment requirements ( CCR 26353 2637. 2, 2665, 2712) • -On 09/29/2020 , a repair permit ( SR0082633) was approved and emailed to the contractor and the operator to replace the 87 and 91 tank drop tubes The contractor confirmed receipt of the approved permit. As of 11 /08/2021 work has not been completed at this site . Immediately take all necessary steps to bring this site into compliance to avoid the entire UST system being red tagged 7-days from the receipt of this Notice.
