Per Owner Dan <br /> Dumas,the diesel and absorbent pads were deemed waste. <br /> Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, <br /> and disposal facility(TSDF)or other authorized point. <br /> REGULATION GUIDANCE: Any person who knowingly transports or causes the transportation of hazardous waste, <br /> or who reasonably should have known that he or she was causing the transportation of any hazardous waste,to a <br /> facility which does not have a permit from the department issued pursuant to this chapter, or at any point which is <br /> not authorized according to this chapter, shall, upon conviction, be punished by imprisonment in a county jail for not <br /> more than one year or by imprisonment pursuant to subdivision (h)of Section 1170 of the Penal Code. <br /> CORRECTIVE ACTION: Immediately cease transportation of hazardous waste to J&H Marine, Inc. Provide a <br /> corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection report was provided to the facility operator on the day of inspection. The report was amended <br /> and replaces the initial report. Violation 203 was added. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by January 15, 2021. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
