S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUNTY <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> TIKI LAGUN RESORT&MARINA 1 12988 W MCDONALD RD, STOCKTON December 15, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 107 CCR 66262.20 Failed to prepare manifests for transportation of hazardous waste. <br /> OBSERVATION:Approximately 90 gallons of diesel fuel and 15 pads were transported off site for disposal on <br /> December 9, 2021,without first preparing a Uniform Hazardous Waste Manifest. <br /> REGULATION GUIDANCE: A hazardous waste generator who transports, or offers for transport a hazardous <br /> waste for off-site transfer,treatment, storage, or disposal shall prepare a Uniform Hazardous Waste Manifest(OMB <br /> Control number 2050-0039)on EPA Form 8700-22, and, if necessary, a Continuation Sheet on EPA Form 8700- <br /> 22A, according to the instructions included in the Appendix to chapter 12 of this division before the waste is <br /> transported off-site. <br /> CORRECTIVE ACTION: When required by California Health &Safety Code and Title 22 California Code of <br /> Regulations, ensure that an Uniform Hazardous Waste Manifest is prepared each time to transport hazardous <br /> waste from this facility for off-site transfer, treatment, storage or disposal. Provide a corrective action statement and <br /> any supporting documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> 201 HSC 25163(a)Failure to use a DTSC registered transporter to transport hazardous waste. <br /> OBSERVATION: This business transported hazardous waste without a valid hazardous waste transporter <br /> registration. The hazardous waste consisted of approximately 90 gallons of diesel fuel and 15 diesel contaminated <br /> pads and was transported by the facility on December 9, 2021. The hazardous waste was transported to J&H <br /> Marine, Inc, located at 401 N San Jose St, Stockton. The transporter could not provide valid hazardous waste <br /> transporter registration or manifest records during the inspection. <br /> VIOLATION GUIDANCE: California Health &Safety Code section 25163(a) <br /> CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without <br /> valid hazardous waste registration issued by the California Department of Toxic Substances Control. Provide a <br /> corrective action statement and supporting documentation to the San Joaquin County Environmental Health <br /> Department within 30 days. <br /> This is a Class I violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by January 15, 2021. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign.
