Generators <br /> W at is a Generator? <br /> A generator is any person,by sitd7 w ose act or process produces hazardous w ste identified or listed in Chapter 11 of the hazardous <br /> a w ste regulations oh w ose act first causes a hazardous w ste to becom subject to regulation. <br /> VM en determ ning if the generator regulations(Chapter 12-Standards Applicable to Generators of Hazardous Va ste)apply to you, <br /> there are 3 inp ortant tem used in the definition to consider: <br /> • "person"(defined in regulation)includes any entity involved in the process of producing a hazardous w ste(e.g.,an individual, <br /> trust,firm joint stock corm any,business concern,corporation,a city or county) <br /> • "by site"(not defined in regulation)refers th w ere the hazardous w ste is generated.Hazardous w ste generation is tracked <br /> on a site-specific basis through unique EPA Identification(ID)nurb ers.Hazardous w ste generation should be evaluated <br /> collectively on a single piece of property for any activities occurring under the control of theimw er or operator.For exanp le,if <br /> a corp any has three facilities operating on the sane piece of property,only one EPA ID nurb er is required.How ver,if a <br /> corp any has three facilities operating on separate non-contiguous properties,then three separate and distinct EPA ID <br /> numb ers ra st be used. <br /> • "act"(not defined in regulation)clarifies that to be a generator,a"person"does not necessarily have to produce the hazardous <br /> a w ste.For exanp le,if a cleaning service renin ves residues from a product storage tank excluded in§66261.4(c),the person <br /> renin ving the residues is a generator,as they cause the w ste to becom subject to regulation.But the imw er of the storage <br /> tank is also considered the generator,since they produced the w ste.By ra tual agreene nt,theseatw parties ra y determine <br /> h w o is responsible for the hazardous w ste.For nm re inform tion,see Federal Register 10/30/1980,Part XI and RCRA O line <br /> #13280. <br /> Generators are responsible for properly characterizing(or identifying)all their hazardous w stes.The steps set forth to m ke such a <br /> determination are found in section 66262.11n O ce a generator determ nes thein w ste m ets the definition of a hazardous w ste,the <br /> requirem nts that apply to them depends on the arm unt(or volum )generated.The Defining Hazardous VM ste w b page provides a <br /> good introduction to understanding how to m ke determ nations on youa w ste. <br /> In addition,free California Hazardous V4 ste Classification online training is available. <br /> Generator Classification <br /> In California,generators are divided into 2 categories: <br /> • Generators of 1,000 kg or nm re of hazardous w ste per nm nth,excluding universal w stes,and/or rm re than 1 kg of acutely <br /> or extrem ly hazardous per no nth(comm my referred to as Large Q antity Generators(RQ s)),or <br /> • Generators of less than 1,000 kg of hazardous w ste per no nth,excluding universal w stes,and/or 1 kg or less of acutely or <br /> extrene ly hazardous w ste per no nth(defined as Sm U Q antity Generators(SQ s)). <br /> If you have P-Listed hazardous w ste,please read this 12/24/2015 letter regarding P-listed hazardous w ste containers at California <br /> Healthcare Facilities. <br /> Each type of generator na st corp IV w th itsrmw set of requirem nts.For rm re inform tion please see the Generator chart. <br /> Does California have a conditional exetp tion forsm Her quantity generators(i.e.,generators of 100 kg or less of hazardouarw ste)? <br /> o N .California did not adopt the conditional exerp tion for sm Iler quantity generators in 40 CFR 261.5 including the counting <br /> requirem nts found in that section.Therefore,in California generators of 100 kg or less of hazardous w ste per nm nth are regulated as <br /> 6Q s and not Conditionally Exenp t Sm U Q antity Generators(CBSQ s)as they w uld be under the federal hazardous w ste <br /> m nagem nt program <br /> Generators that periodically fall above or below their norma I generation limit <br /> If the arrm unt of hazardous w ste produced in a calendar no nth puts a generator in a different category,then they are responsible for <br /> corp lying w th the applicable standards for that category of generator for that no nth(e.g.,if a generator produces 500 kg of hazardous <br /> in June,they ra st corp fy w th the6Q requirem nts but if they produce 1,200 kg of hazardous w ste in the next no nth they nu st <br />
