ANJOAQUIN COUNTY— Environmental Health Department AMENDED 1/6/2021 Large Quantity Hazardous Waste Generator Inspection Report Facility Name: Facility Address: Date: TRACY CDJR 3460 NAGLEE RD, TRACY December 07, 2020 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) Item # Remarks 714 HSC 25201.16(f) Failed to properly store and label containers of hazardous waste aerosol cans. OBSERVATION: The facility is managing universal waste (UW) aerosol can storage containers in a way that is out of compliance with this section. The following was observed adjacent to hazardous waste storage area by offices: -One 55 -gallon container with universal waste aerosols observed with non -secure lid. REGULATION GUIDANCE: (f) Any container used to accumulate or transport universal waste aerosol cans, or the contents removed from a universal waste aerosol can or processing device, unless the contents have been determined to not be hazardous waste, shall meet all of the following requirements: (1) (A) Except when waste is added or removed or as provided in subparagraph (B), the container shall be closed, structurally sound, and compatible with the contents of the universal waste aerosol can, and shall show no evidence of leakage, spillage, or damage that could cause leakage under reasonably foreseeable conditions. (B) The closed container requirement in subparagraph (A) does not apply to a container used to accumulate universal waste aerosol cans prior to processing the cans pursuant to subdivision (h), or prior to shipping the cans offsite, except that the container shall be covered at the end of each workday. (2) The container shall be placed in a location that has sufficient ventilation to avoid formation of an explosive atmosphere, and shall be designed, built, and maintained to withstand pressures reasonably expected during storage and transportation. (3) (A) The container shall be placed on or above a floor or other surface that is free of cracks or gaps and is sufficiently impervious and bermed to contain leaks and spills. (B) Subparagraph (A) does not apply to a container used to accumulate universal waste aerosol cans prior to processing the cans pursuant to subdivision (h) or prior to shipping the cans offsite. (4) Incompatible materials shall be kept segregated and managed appropriately in separate containers. (5) A container holding flammable wastes shall be kept at a safe distance from heat and open flames. (6) A container used to hold universal waste aerosol cans shall be labeled or marked clearly with one of the following phrases: "Universal Waste -Aerosol Cans", "Waste Aerosol Cans", or "Used Aerosol Cans". CORRECTIVE ACTION: Please secure lid on to one 55 -gallon container in a manner that will prevent release of universal waste aerosol cans. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department (EHD) within 30 days. This is a Class II violation. Overall Inspection Comments: An inspection report was provided to the facility operator on the day of inspection. The report was amended on 1-6-2021 and replaces the initial report. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, within 30 days of receiving the amended inspection report.
