I San Joaquin County Environmental Health Department <br /> 2 Certified Unified Program Agency <br /> 3 1868 E . Hazelton Avenue <br /> 4 Stockton , California 95205 <br /> 5 A photocopy of the check shall be sent to the following CUPA personnel assigned to this <br /> 6 matter at the above - identified address : Michelle Henry , San Joaquin County Environmental <br /> 7 Health Department . If Respondent fails to make payments as provided above , Respondent <br /> 8 agrees to pay interest at the rate established pursuant to HSC § 25360 . 1 and to pay all <br /> 9 costs incurred by the CUPA in pursuing collection including attorney ' s fees . <br /> 10 <br /> OTHER PROVISIONS <br /> 11 <br /> 12 12 . 1 . Additional Enforcement Actions : By agreeing to this Consent Order , <br /> 13 the CUPA does not waive the right to take further enforcement actions , <br /> 14 except to the extent provided in this Consent Order . <br /> 15 12 . 2 . Penalties for Noncompliance : Failure to comply with the terms of this <br /> 16 Consent Order may subject Respondent to civil penalties and /or punitive <br /> 17 damages for any costs incurred by the CUPA or other government agencies <br /> 18 as a result of such failure , as provided by HSC § 25404 . 1 . 1 and other <br /> 19 applicable provisions of law . <br /> 20 12 . 3 , Parties Bound : This Consent Order shall apply to and be binding <br /> 21 upon Respondent , its successors and assigns , and the following persons and <br /> 22 entities with actual notice of this injunction and doing business in California : <br /> 23 Respondent ' s officers , directors , and agents , and upon the CUPA and any <br /> 24 successor CUPA that may have responsibility for and jurisdiction over the <br /> 25 subject matter of this Consent Order . <br /> 26 <br /> 12 . 4 .
