The following is an itemized list of hazardous waste violations that have not been addressed for Zacky Farms as of January 08, 2021. Open violations from September 25, 2019 inspection -One 5 gallon bucket labeled"Kelly Moore Paints." Roof: -One 1 gallon bottle labeled"Simple Green"was placed next to an unlabeled spray bottle labeled REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. CORRECTIVE ACTION: Immediately cease disposal, make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation for each hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. If an item is determined to not be a waste, submit a statement explaining what will be done it. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#104-No modified contingency plan. OBSERVATION: A complete modified contingency plan was not posted at the facility. REGULATION GUIDANCE: The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator,the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately post the required information at the facility.
