OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifest (UHWM) 006453758GBF (4/7/2021). REGULATION GUIDANCE: (a) A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c) A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest, with some indication that the generator has not received confirmation of delivery. (d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifest and send a copy to the San Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 days. This is a Class II violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: Oil saturated dirt was observed in several spots throughout the yard. REGULATION GUIDANCE: A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non -sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. CORRECTIVE ACTION: Immediately fix the leaking equipment and clean up the soil. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up waste. This is a repeat violation, Class II. Overall Inspection Comments: An inspection report was provided to the facility operator on April 14, 2021. Later the same day, the report was amended by the EHD. This amended report replaces the initial report. The report was amended to change the Inspection Type from "ROUTINE INSPECTION - Operating Permit" to "INSPECTION / SERVICE (Chargeable)".
