SAN JOAQUIN <br />CCUNT <br />Environmental Health Department <br />Permit By Rule Treatment Facility Inspection Report <br />Facility Name: <br />1 <br />Facility Address: <br />Date: <br />METAL FINISHING SOLUTIONS - STOCKTON <br />1325 EL PINAL DR, STOCKTON <br />July 20, 2021 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />101 <br />HSC 25201(a) Failed to obtain a permit to treat hazardous waste. <br />OBSERVATION: A hazardous waste treatment permit has not been issued to this facility for 2021 since an open <br />violation for an incomplete hazardous waste tank assessment is not resolved from the 8-31-20 inspection. <br />REGULATION GUIDANCE: <br />California Health & Safety Code (HSC) section 25201(a) No owner or operator of a storage facility or treatment <br />facility shall treat, store, or dispose of a hazardous waste at the facility, unless the owner or operator holds a <br />hazardous waste facilities permit or other grant of authorization from the department to use and operate the facility, <br />or the owner or operator is operating under a permit -by -rule pursuant to the department's regulations, or a grant of <br />conditional authorization or conditional exemption pursuant to this chapter. <br />Title 22 California Code of Regulations section 66260.10 California Health & Safety Code (HSC) section 25123.5 <br />CORRECTIVE ACTION: Immediately cease treatment of hazardous waste until a permit is issued by the EHD for <br />all treatment activities at this site. Store and dispose of the hazardous waste as specified in Title 22 California Code <br />of Regulations until the treatment permit is obtained. Provide a corrective action statement and supporting <br />documentation to the EHD within 30 days. <br />This is a Class I violation. <br />104 <br />CCR 67450.3(c)(1) Failed to submit an onsite annual hazardous waste treatment notification by January 1. <br />OBSERVATION: This facility is treating hazardous waste but has not submitted the annual treatment notification <br />information to the California Environmental Reporting System (CERS) by January 1 for the following years: 2021 <br />(submitted late on 1/8/2021), 2020 (submitted late on 9/10/2020), 2019 (not submitted). <br />REGULATION GUIDANCE: <br />The owner or operator of a fixed treatment unit (FTU) that treats hazardous waste shall submit in the California <br />Environmental Reporting System (CERS) the following sections: the Business Activities Page, the Business <br />Owner/Operator Page and the Onsite Hazardous Waste Treatment Notification -Facility page and subsections. The <br />submittal shall be made by January 1 of each year following the first treatment of waste with the FTU, and by <br />January 1 of each subsequent year. <br />CORRECTIVE ACTION: Ensure the required annual Hazardous Waste Treatment notification in CERS is submitted <br />by January 1 each year for review by the San Joaquin County Environmental Health Department (EHD).
