OBSERVATION: The designated operator employee training for 2021 has not been performed. The most current training record available at the time of the inspection was dated 01/21/2020. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. This is a Class II violation. 319 CCR 2635, 2637.2,2665, 2712 Failure to comply with overfill prevention equipment requirements. OBSERVATION: The fill tube shut-off valve used as the overfill prevention system is not currently functional on the 91 UST. REGULATION GUIDANCE:All UST systems must be equipped with an approved,functional overfill prevention device at all times during delivery operations. CORRECTIVE ACTION: Immediately discontinue deposition of petroleum into the 91 tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the failed component can't be replaced immediately,there is a possibility that the 91 UST system may be red tagged to prevent fuel inputs. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by October 7, 2021. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
