I have attached the following documentation for your review regarding the spoken concerns and written violations: • 48 hour notification Prior to the testing (email subject: Costco Lodi Monitor/Cold Start) • Monitoring Certification Report (Sent by contractor within the 30 day deadline) • Monitoring Certification Report (Sent by contractor after the 30 day deadline to make sure it was received) • Submittal of the 5/20/2020 Violation documentation (email subject: Inspection Letter for Costco Lodi) • 5/21/2020 OPE testing Concerns not cited on the violation: 1. Comment 1:Tester failed to provide 48 hour notice prior to testing Response: Please see the attached email "Costco Lodi Monitor/Cold Start"from Alltech Petro.The first email was sent on May 14, 2020 as notification and received verification from your agency on May 15th that the request was logged. 2. Comment 2: Tester failed to submit testing within 30 days after completion Response: Please see the attached emails "2020-05-21 Costco Lodi Monitor" from Alltech Petro. One was sent via email June 16th and again by June 23rd Clarifying question on cited items: 1. Observation 1: An inspection was last done on 5/21/2020 and an inspection report was issued identifying information to be submitted to bring this site into compliance.This information was required to be submitted by 7/17/2020.This information was received late on 11/13/2020. Regulation Guidance:An operator that receives an inspection report shall have 30 days to implement the corrections specified in the inspection report and comply with conditions. The corrective action shall include all of the recommendations made in the report.The operator shall submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions will be taken.
