OBSERVATION: A complete modified contingency plan was not posted at the facility. REGULATION GUIDANCE: The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately post the required information at the facility. Provide a statement to the San Joaquin County Environmental Health Department that the correction is complete. This is a minor violation. 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented)that employees who handle hazardous waste were properly trained, based on the following observations: 1. On 10/20/2020, according to Carey Johnson, Receiver and the employee who is primarily responsible for placing hazardous waste into the hazardous waste storage containers, stated that she no longer had access to the scanning system previously used to determine which hazardous waste category a damaged item belonged in. On 10/21/2020, Sergio Escalera, Raley's Environmental Health&Safety Manager, stated that the scanning system was still available for employees to use, but it was under an old system within the scanner that employees would need to learn how to access. On 1/13/2021, Sergio requested that the violation be amended to note that at the time of inspection Carey Johnson was in fact properly trained on how to use the scanning system, and that the scanning system was not working due to an information technology(IT)issue.According to Sergio's return to compliance paperwork received by the EHD on 11/20/2020,the IT issue was resolved. 2. See violation 605. REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and emergencies. CORRECTIVE ACTION: Immediately train/re-train the employees. Provide proof of training/re-training, and a copy of the training materials within 30 days to the San Joaquin County Environmental Health Department(EHD)for employees whose responsibilities include hazardous waste.
