APPROVE DEFERRED CONDITIONS OF APPROVAL AGREEMENT <br />(APNS: 207-032-012/016 - CATON) <br />RECOMMENDED ACTION: Approve Deferred Conditions of Approval Agreement <br />BACKGROUND AND/OR HISTORY: <br />Oakdale Irrigation District (OID) has reviewed the proposed Minor Subdivision Map submitted to the <br />San Joaquin County Community Development Department with the Landowner, Mr. Al Caton, Mr. <br />Caton proposes to combine two (2) existing parcels into one (1) 186.3 acre remainder parcel and <br />create a new 16.6 acre parcel at the existing Caton Dairy on Campbell Road, north of Lone Tree <br />Road, as shown on the attached Tentative Map. The above -noted parcels are located within the <br />unincorporated area of San Joaquin County and are currently listed as irrigable. <br />The Caton Dairy has historically irrigated not just the two (2) project parcels, but all five (5) of the <br />contiguous parcels that comprise the Caton Dairy as one (1) parcel. Mr. Caton's proposed Minor <br />Subdivision Map has been prepared for estate planning purposes and Mr. Caton has no intention of <br />selling either of the project site parcels at this time. Mr. Caton wrote a letter on April 12, 2012 <br />requesting that the OID conditions of approval for his map that involve independent irrigation and <br />drainage per parcel be deferred. After reviewing Mr. Caton's project with him, OID Staff is <br />recommending a Deferred Conditions of Approval Agreement to allow the parcels to continue to <br />irrigate in the historic manner until such time as either of the project parcels are sold or have a <br />change in ownership or land use. This project has not been to the Water Committee given past <br />direction by both the Committee and the Board.
