(NES) <br /> to provide the following services: <br /> NES will prepare and present quarterly environmental training programs(AM and PM ses- <br /> sions) for California.Tank Lines, Inc. (Cal Tank) employees. Quarterly training will cover <br /> the following; topics. Confined Space Operations, SPCC: & Spill Response, Hazardous <br /> Waste, Hazard Communication& GHS, and DOT. All instructor and participant materials <br /> (laptop, projector, course handouts, and certificates of completion) for these training pro- <br /> grams will be Provided by NES; Cal 'rank will be responsible for providing the training <br /> room and seating. Quarterly training will be provided on agreed upon dates in 2020. <br /> Our terrns and conditions for this project are as follows: <br /> ➢ Services are to be initiated upon approval of this LOA, The Contract Terms and Conditions <br /> attached to this LOA are an integral part of our agreement(Attachment A). <br /> > Services are priced on a fixed fee basis.NES does no� accorunt for labor hours and incidental <br /> expenses on fixed fee contracts unless requested prt°or to the start of services. In the event <br /> a detailed breakdown of labor hours and expenses is required, NES will provide services <br /> on a time & materials basis. The fixed price: will be; adjusted, and a revised cost estimate <br /> for services will be provided and will include charges for the additional accounting costs. <br /> NES is unable to provide services on a time & materials basis or to provide a detailed <br /> breakdown of charges on fixed fee; services after work is started under this agreement. <br /> All NES services are progress-billed on a monthly basis, unless otherwise previously ar- <br /> ranged and agreed upon b� both parties. <br /> Invoices are duo on a net 30-day basis.
