Hazelton Avenue <br /> Stockton, CA 95201 <br /> NOTICE OF VIOLATION <br /> DETECTION OF GROUND WATER CONTAMINATION, CORRAL HOLLOW ROAD LANDFILL, SAN <br /> JOAQUIN COUNTY (CASE# 1896) <br /> Four quarters of monitoring data have indicated that a release of volatile <br /> organics has occurred. Evidence for the release consists of the presence 'of <br /> volatile organic compounds. California Code of Regulations, Title 23, <br /> Division 3, Chapter 15, Article 5 requires the County to determine whether <br /> there is statistically significant evidence of a release from the landfill at <br /> each monitoring point, within a reasonable period of time. Since the <br /> compounds are anthropogenic or have no natural background, no statistical <br /> analysis is needed (see enclosed memo dated 16 October 1991.) <br /> The County is required to notify the Regional Board by certified mail within <br /> seven days of determining that a release has occurred. A more than reasonable <br /> amount of time has passed since detection of a release. Therefore, San <br /> Joaquin County, as operator of the Corral Hollow Landfill , is in violation of <br /> California Code of Regulations, Title 23, Division 3, Chapter 15, Article 5, <br /> Section 2550.8(i) (2) . <br /> In the absence of notification from San Joaquin County, this letter shall <br /> serve as notice under Section 2550.0(1) (3) that the Regional Board has made an <br /> independent finding that a release has occurred.. In order to correct the <br /> County's violations of Chapter 15, we request the County begin immediately to <br /> follow the actions required by Section 2550.8(j) when a release is found. The <br /> County shall submit a Technical Report within 90 days which includes a <br /> detailed description of the measures to assess the nature and extent of the <br /> release from the landfill . The Technical Report should include a time <br /> schedule for completing the actions described in the Technical Report. <br />
