The following is an itemized list of hazardous waste violations that have not been <br /> addressed for MANTECA DENTAL CARE as of October 19 , 2021 . <br /> Open violations from February 09 , 2021 inspection <br /> Violation #102 - Failed to determine if a waste is a hazardous waste . <br /> OBSERVATIONS : <br /> The facility uses ImageMax Developer Cleaner to clean x-ray equipment. The Safety Data Sheet indicates that it <br /> contains sodium dichromate and sulfuric acid with a pH of 1 . The spent cleaner is mixed with the photo processing <br /> waste without first making a hazardous waste determination . <br /> The facility processes x-rays using ImageMax Developer and Fixer Concentrate. One receipt, dated October 2020 , <br /> shows the spent Developer and Fixer being hauled off site by Stericycle as photochemical/photoprocessing waste, <br /> Non- RCRA Waste on a non-hazardous shipping document. The facility did not have documentation to support the <br /> determination that the waste is not hazardous waste . <br /> The facility is disposing of waste dental materials such as teeth whitener, tooth impression materials , adhesives in <br /> the trash containers on site . The facility did not provide Safety Data Sheets or other documentation to support the <br /> determination that the waste is not hazardous waste . <br /> REGULATION GUIDANCE : Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations (CCR) . There are wastes that are listed as hazardous <br /> wastes . There are wastes that exhibit one or more of the hazardous waste characteristics : toxic, corrosive , reactive <br /> or ignitable. <br /> Title 22 CCR section 66261 . 2 — Definition of Waste <br /> Title 22 CCR section 66261 . 3 — Definition of Hazardous Waste <br /> CORRECTIVE ACTION : <br /> Start keeping the spent ImageMax Developer Cleaner in a separate container, make a hazardous waste <br /> determination , and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS ) , waste sampling and test <br /> results or other knowledge to support your hazardous waste determination . Waste testing must be done using <br /> methods specified in Title 22 CCR including sections 66261 . 20-24 . <br /> Provide hazardous waste determination information for the spent Developer and Fixer. <br /> Provide hazardous waste determination information for waste dental materials such as teeth whitener, tooth <br /> impression materials , and adhesives . <br /> Submit a statement and supporting documentation with your hazardous waste determinations . Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes .
