In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action) . This site is out compliance for the following : • CCR 2636 , 2643 (c) ( 1 ) , 2666 (f) Failure to install a line leak detector. On 5/26/2021 , violation #310 was issued . The pressurized piping on the 87 tank (former 89 tank , closest to the store) is not equipped with an automatic line leak detector. • CCR 26351 2637 . 2 , 2665 , 2712 Failure to comply with overfill prevention equipment requirements . On 5/ 12/2020 EHD received an Overfill Prevention Inspection Report dated 5/2/2019 . A notification was not previously submitted to EHD . 48-hour notifications are required for testing being conducted on UST systems . EHD will not accept this 5/2/2019 testing . Overfill Prevention Equipment testing has not been conducted for this site . The monitoring plan for the tanks state fill tube shut-off valves are the sole overfill prevention method , but fill tube shut-off valves were not observed during the inspection . Immediately take all necessary action to bring this into compliance to avoid the entire system being red tagged 7- days from the receipt of this Notice .
